Terms of Service

Agreement
These Terms of Service (“Terms”) form a binding agreement between you (or the entity you represent) and Brisk Birds LLC (“Bounso”, “we”, “us”). If you are using Bounso on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
The service
Bounso is an email verification platform. We accept email addresses you upload and return a verification result indicating whether they appear deliverable, undeliverable, catch-all, or risky. We perform this verification using DNS lookups, SMTP probes, and third-party provider signals.
Bounso is provided as a software-as-a-service product. We may improve, modify, or discontinue features from time to time. We’ll give you reasonable notice before making material adverse changes that affect paying customers.
Your account
- You must provide accurate, current, and complete information when you sign up, and keep it up to date.
- You're responsible for the security of your account credentials and API keys. Don't share them. If you suspect they've been compromised, rotate them immediately.
- You're responsible for all activity that occurs under your account, including activity by your team members or anyone you give credentials to.
- You must be at least 18 years old to use Bounso.
Acceptable use
You agree that you will not use Bounso to:
- Verify lists you don't have a lawful basis to process, including lists scraped from sources whose terms prohibit scraping, lists purchased without consent, or lists obtained in violation of any anti-spam law (including CAN-SPAM, GDPR, CASL, and others).
- Send unsolicited bulk email, harass any person, or facilitate phishing or fraud.
- Reverse engineer, decompile, or attempt to extract our source code, model weights, or proprietary algorithms.
- Probe, scan, or test the vulnerability of the service or attempt to bypass any security or authentication.
- Use the service in any way that could disable, overburden, damage, or impair it, or interfere with any other user's use of it.
- Resell or sublicense the service in a way that competes with Bounso or that exposes our API directly to your end users (a customer-facing white-label requires written approval).
- Use the service for any unlawful, infringing, defamatory, obscene, or otherwise objectionable purpose.
We may suspend or terminate accounts that violate these acceptable-use rules, without refund.
Credits and billing
How credits work
- Each email you submit for verification consumes credits at the rate published on your plan page.
- Cached results served from a recent verification do not consume additional credits.
- Failed verifications (e.g., DNS lookup failure for an obviously malformed address) generally do not consume credits, except where noted on the pricing page.
Plans and renewal
- Paid plans renew automatically at the end of each billing period (monthly or yearly) until you cancel.
- We charge your saved payment method on the renewal date. If a charge fails, we'll retry and notify you; if payment remains unresolved, your access to paid features may be suspended.
- Unused credits expire at the end of each billing period unless your plan specifies otherwise.
- We may change pricing for future billing periods with at least 30 days' notice. Existing paid periods are unaffected.
Taxes
Prices are exclusive of applicable taxes. You’re responsible for any sales, use, VAT, GST, or similar taxes that apply to your purchase.
Refund policy
- Within 7 days of your initial purchase, if you have not used any credits, you may request a full refund of that purchase by emailing billing@bounso.com.
- If you have used credits, those credits are non-refundable.
- We do not offer refunds for partial billing periods or for unused credits that expire at the end of a billing period.
- Lifetime deals are non-refundable after 14 days, regardless of usage.
- If we materially fail to deliver the service in a way attributable to us, we'll work with you to issue a prorated credit; this is your sole remedy in that case.
Service availability
We aim to make the service available 24/7, but we don’t guarantee uninterrupted operation. Scheduled maintenance, third-party provider outages, and force-majeure events can affect availability.
- Free tier: provided as-is with no uptime commitment.
- Paid tier: we target 99% monthly uptime, excluding scheduled maintenance and force majeure.
- If we fall below the paid-tier uptime target for a full calendar month, you may request a service credit equal to 5% of that month's fee per percentage point below target, capped at 50% of the monthly fee. Service credits are your sole remedy for downtime.
Your data
You retain all rights to the email lists and other content you upload (“Customer Data”). You grant us a limited license to process Customer Data solely to deliver the service to you and to improve internal product quality on an aggregate, non-identifying basis.
We process Customer Data on your behalf as a processor, governed by our Data Processing Addendum. Our Privacy Policy describes how we handle personal data about you and your account.
Intellectual property
Bounso, including all software, designs, text, graphics, logos, and trademarks, is owned by Brisk Birds LLC. These Terms do not grant you any rights in our intellectual property other than a limited, revocable, non-exclusive, non-transferable license to use the service for its intended purpose.
If you give us feedback or suggestions, you grant us a perpetual, royalty-free license to use that feedback to improve the service.
Warranties and disclaimers
We provide the service “as is” and “as available”. To the maximum extent permitted by law, we disclaim all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
Email verification is probabilistic. We do not guarantee 100% accuracy. We do not guarantee that any email address verified through Bounso will accept mail, or that deliverability outcomes will improve. Catch-all and accept-all servers, in particular, cannot be verified deterministically.
Limitation of liability
To the maximum extent permitted by law, neither party will be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including loss of profits, revenue, data, or business opportunity, even if advised of the possibility of such damages.
Our total aggregate liability arising out of or relating to these Terms or your use of the service will not exceed the greater of (a) the total fees you paid to us in the 12 months preceding the event giving rise to the claim, or (b) US$100.
Some jurisdictions don’t allow certain limitations of liability, so portions of this section may not apply to you.
Indemnification
You agree to defend, indemnify, and hold harmless Brisk Birds LLC and its officers, directors, employees, and agents from any claim, damages, or expenses (including reasonable attorneys’ fees) arising from (a) your breach of these Terms or applicable law, (b) your Customer Data, or (c) your violation of any third-party rights.
Termination
By you
You can cancel your account at any time from the dashboard or by emailing support@bounso.com. Cancellation stops the next renewal but doesn’t refund the current billing period (except as described in the refund policy).
By us
We may suspend or terminate your account immediately, without liability to you, if (a) you breach these Terms, (b) we suspect fraud or abuse, (c) you fail to pay fees that are due, or (d) we’re required to by law. We may also discontinue the service or any plan on at least 30 days’ notice; if we do, we’ll prorate and refund any unused paid period.
Effect of termination
On termination, your right to use the service ends. We’ll delete or anonymize your data in accordance with our retention policy and the DPA. Sections of these Terms that by their nature should survive termination will survive.
Changes to the service or these terms
We may update these Terms from time to time. If we make material changes, we’ll notify you by email or via a prominent in-product notice at least 30 days before the change takes effect (except where a shorter period is required by law). Continued use of the service after the effective date constitutes acceptance of the updated Terms.
Governing law and disputes
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-laws rules. The state and federal courts located in Delaware will have exclusive jurisdiction over any dispute arising out of or relating to these Terms, and each party consents to that jurisdiction.
If you are a consumer resident in the European Union or United Kingdom, the mandatory consumer protection laws of your country of residence also apply.
General
- Entire agreement. These Terms, together with the Privacy Policy and DPA, are the entire agreement between you and us about the service.
- Severability. If any part of these Terms is held unenforceable, the rest will remain in effect.
- No waiver. Our failure to enforce any provision is not a waiver of the right to enforce it later.
- Assignment. You may not assign or transfer these Terms without our written consent; we may assign these Terms in connection with a merger, acquisition, or sale of assets.
- Force majeure. Neither party is liable for failures caused by events beyond reasonable control.
